It doesn't fizzle the spell since all legal targets have already been checked (again, keyword is target) For cryptic, the situations where the entire spell fizzles is when all instances of "target" are illegal.
So in the case that you choose to return target permanent and draw a card, if that permanent becomes illegal (hexproof, already destroyed, etc) the rest of the spell fizzles.
So for mindbender, the only time you are targeting is target player.
Now if their hand doesn't have a 3cmc or less and/or 4cmc or more, then you just do the most you can do.
